PRICES:

Prices are subject to change without notice, but we will not change our prices unless absolutely necessary. Orders will be invoiced at the price prevailing at the time of shipment. Prices to be paid in U.S. currency only.

TERMS:

Full payment is expected with each order, either by check or credit card (Visa and MasterCard accepted.) A fee of $25.00 will be charged for any checks returned. Appropriate collection fees and/or legal expenses, including the cost of any lawsuit, will be charged to any overdue account to the extent permitted by law. C.O.D. orders need to add $10.00 to the shipping costs.

BACKORDERS:

Items not in stock will be backordered unless item is sold out or a crop failure. Unless customer notifies De Bruyn Seed Co. in writing, all backorders will be shipped. If payment is over the amount that is filled, the difference will be credited to you, and applied to your next purchase.

SHIPPING:

We ship out the orders via UPS or the US mail, whichever is the most cost efficient. Please allow 7 to 10 business days for delivery. Remember to add the appropriate amount of shipping charges to your order. Remember that if your order weighs more than 55 pounds it will be sent in more than one box. Costs of special shipping arrangements (i.e. COD delivery) will be added to your total. Please make sure that you have included your shipping address, not a post office box number as your address. A $1.75 UPS surcharge will be added to each package going to a rural residence or small cities (under 20,000 people.)

Orders Amounting To:  
Under 1 lb. Add $5.80 shipping and handling charge
1 lb. to 5 lb. Add $10.80 shipping and handling charge
With transportation costs changing daily, it is almost impossible to have an accurate chart. I promise to do my best to send your orders the most inexpensive way that I can, whether that be by US mail, UPS or FedEx. INTERNATIONAL SALES: (outside the continental U.S.)

Due to varying postal rates and customs regulations, special rates and billing will be applied to all orders.

SEED RETURNS:

Any returns must be authorized by our main office. We have no control over the environment in which the seed is stored after leaving our premises. For the protection of all our customers, we will accept no seed returns for any reason other than an error on our part in filling your order. Our main office must be notified within 10 days of receiving the order of any error on our part in filling your order. Opened containers cannot be returned for any reason. The main office reserves the right to charge a restocking fee.

SPECIAL NOTE:

Beans, peas, small vegetable seeds and flowers come untreated. Sweet corn seed comes treated. We advise commercial growers to treat all seed before planting for maximum germination in cold soil. We advise not to plant any XtraSweet corn until soil temperatures are above 60 degrees, and plant at least 100 feet away from other varieties of corn.

Limitation of Warranty and Remedy:

De Bruyn Seed Co. warrants that the seed it sells conforms to the label descriptions and as described in its catalog as required by Federal and State seed laws within recognized tolerances. IT MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR PURPOSE, OR OTHERWISE, AND IN EVENT ITS LIABILITY FOR BREACH OF ANY WARRANTY WITH RESPECT TO SUCH SEEDS IS LIMITED TO THE PURCHASE PRICE OF SUCH SEEDS. Under no circumstances shall De Bruyn Seed Company be liable for any incidental or consequential damages, nor for amounts expended in using or growing such seed, nor for harvesting the produce of such seed. DE BRUYN SEED COMPANY FURTHER LIMITS TO SUCH PURCHASE PRICE ITS LIABILITY OF ANY KIND ON ACCOUNT OF ANY NEGLIGENCE WHATSOEVER ON ITS PART WITH RESPECT TO SUCH SEEDS.

Acceptance of seeds upon delivery shall constitute acceptance of these terms, conditions and warranties.

In the event of resale by the purchaser, De Bruyn Seed Company does not assume any warranties, expressed or implied, by the purchaser or liability for any negligence on the part of the purchaser.

These warranties and limitations of liability of De Bruyn Seed Company may not be altered or amended except by an instrument in writing signed by De Bruyn Seed Company. Any claims and problems due to defects or any other factors which result from the use of seeds purchased from De Bruyn Seed Company must be presented to the main office of De Bruyn Seed Company within 10 days from the receipt of the seeds. De Bruyn Seed Company will not assume any responsibility after the above mentioned 10 day period.

Any claim against De Bruyn Seed Company is subject to mandatory nonbinding arbitration as described by the American Arbitration Association. By acceptance of the seeds the buyer acknowledges that the limitations and disclaimers herein described are conditions of sale and that they constitute the entire agreement between the parties regarding arbitration, warranty, remedy or any other liability.

Any dispute not subject to arbitration and any action to enforce an arbitration award arising from the sale hereunder shall be brought forth and litigated in a court located in the county of Ottawa County, state of Michigan, to the exclusion  of the courts of any other county, state or country.

NOTICE TO PURCHASER REGARDING DISEASES: De Bruyn Seed Company makes no representation regarding the freedom of seedborne diseases and disclaims any liability relating to such disease whether previously known to exist or not identified until this seed is grown.
